Terms and Conditions
Effective August 5, 2026
These Terms govern use of the KAizen Chess Lab website, applications, chess-analysis tools, AI coaching, training features, and related services operated by KAizen Chess Lab LLC ("KAizen," "we," "us," or "our"). By creating an account, purchasing a subscription, or using the service, you agree to these Terms.
Eligibility and accounts
You must be at least 18 years old and legally able to enter this agreement. You are responsible for accurate account information, protecting your credentials, and activity under your account. Individual subscriptions are for one person unless KAizen approves a separate written organizational license.
Permitted use
KAizen grants you a limited, revocable, non-exclusive, non-transferable right to use the service for personal chess improvement or another expressly approved purpose. You may not resell access; share credentials; scrape or bulk-download the service; bypass billing, authentication, quotas, or security controls; introduce malicious code; interfere with service operation; or use KAizen content, outputs, prompts, workflows, or proprietary systems to build or train a competing product without written permission.
Student content and chess data
You retain your rights in information you submit, such as account details, chess-platform usernames, and game records. You authorize KAizen and its service providers to process that information as needed to operate, secure, support, and improve the service, subject to the Privacy Policy. You represent that you have the right to submit the content you provide.
AI coaching
KAizen combines deterministic chess facts with AI-generated student-facing coaching. AI output can be incomplete or mistaken and is educational information, not a guarantee of rating improvement, competitive results, or professional advice. You remain responsible for how you use the coaching.
Subscriptions, trials, renewal, and cancellation
Paid access, eligible trials, automatic renewal, billing frequency, cancellation, and post-cancellation access are governed by the Subscription Terms and the checkout disclosure shown before purchase. Those Subscription Terms are incorporated into these Terms.
Refunds
Refund eligibility and the correct request channel depend on the purchase origin and applicable law. See the Refund Policy. Cancelling a subscription prevents future renewal but does not automatically create a refund for a completed charge.
Account deletion
Account deletion and subscription cancellation are separate actions. Deleting an account does not necessarily cancel a subscription managed by Stripe, Apple, Google Play, or another purchase-origin platform. Review and complete the steps in the Data Deletion Policy.
Availability and changes
We may update, suspend, limit, or discontinue features and may restrict accounts for nonpayment, fraud, abuse, security risk, illegal activity, or material violation of these Terms. Where reasonable, we will provide notice of material changes or account action. Features may occasionally be unavailable because of maintenance, provider outages, or technical failure.
Intellectual property
KAizen and its licensors retain all rights in the service, software, designs, training systems, analysis methods, prompts, workflows, branding, and other proprietary material. No right is granted except the limited use right stated above.
Disclaimers and limitation
To the extent permitted by law, the service is provided "as is" and "as available" without warranties of uninterrupted, error-free, or completely secure operation. KAizen is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.
Governing law and disputes
These Terms are governed by Pennsylvania law, without regard to conflict-of-law rules. Before filing a claim, contact us and allow a reasonable opportunity to resolve the dispute informally. Any required forum or dispute process remains subject to non-waivable consumer rights and applicable law.
